These terms apply to AvniX Restaurants (“AvniX”, “we”), a product by theavni.studio, Visakhapatnam, India, and to the restaurant or business that signs up (“you”). Your order form or quote, together with these terms, is our agreement.
1. The service
AvniX provides a designed QR code menu, menu management, event listings, guest sign-ups and analytics (Standard), and additionally a waiter dashboard with live and manual orders, daily covers and revenue tracking (Premium). We set up your menu from the material you send us, usually within 2 working days of receiving everything we need.
2. Accounts and access
- You’re responsible for the people you give access to and for keeping their email accounts secure (sign-in is by one-time email codes).
- Tell us promptly if you suspect unauthorised access.
- We may suspend access to protect the service or other customers from misuse or security threats.
3. Fees and billing
- Fees are a one-time setup fee and a monthly subscription, as set out in your quote. The subscription is billed in advance for each billing cycle (for example monthly or every six months).
- Prices exclude taxes (such as GST), which are added where applicable.
- If a payment is more than 7 days overdue, we may remind you and, after notice, suspend the service until it’s paid. Suspension does not delete your data.
- Setup fees are non-refundable once setup work has started. Subscription fees for a cycle already started are non-refundable unless we fail to provide the service.
4. Your content and data
- You own your menu, photos, logos and your guests’ data. You give us permission to use them only to provide the service to you.
- You confirm you have the right to use the content you send us and that you collect guest data lawfully, including telling guests how you use it.
- We process guest data on your behalf as described in our Privacy Policy.
- With your permission we may show your restaurant’s name and logo as a customer on our website; you can ask us to remove it at any time.
5. Acceptable use
Don’t use AvniX for anything unlawful, to send spam, to upload harmful code, to try to break or overload the service, or to access other customers’ data.
6. Our software
AvniX, its design system and code remain ours. You get a right to use the service during your subscription. Designs we create specifically for your menu are for your use.
7. Availability and support
We aim for the service to be available at all times but can’t guarantee it will be uninterrupted. We’ll give notice of planned maintenance where we can and help with issues during Indian business hours (Premium gets priority support).
8. Liability
The service is provided on an “as available” basis. To the extent the law allows, we aren’t liable for indirect or consequential losses (such as lost profits), and our total liability in any 12-month period is limited to the fees you paid us in that period.
9. Ending the agreement
- You can cancel at the end of any billing cycle by telling us in writing.
- Either side may end the agreement if the other seriously breaches it and doesn’t fix the breach within 15 days of notice.
- After it ends, we’ll give you an export of your menu and guest list on request within 30 days, then delete your data (except records we must keep by law).
10. Changes
We may update these terms. We’ll tell customers about material changes at least 30 days in advance; continuing to use the service after that means you accept them.
11. Law and disputes
These terms are governed by the laws of India. We’ll first try to resolve any dispute in good faith; otherwise the courts of Visakhapatnam, Andhra Pradesh have jurisdiction.
